Delhi HC dismisses plea seeking for lifting the ban from Condom Advertisements

On Monday Delhi Court dismissed a plea, stating the removal of a ban on condom ads. The selective hours between which the condom add cannot be aired are 6:00 a.m. and 10:00 p.m.The petition was enrolled by Sarita Barpanda. She debated against the Central Government's decision which deemed a ban on condom advertisement between the hours of 6:00 a.m. and 10:00 p.m. The decision was concluded on December 11, 2017. The decision was heavily referenced by advertisement displaying unfounded content.Ms. Sarita also mentioned that the provisional ban over the advertisements was done without any legal provision. As per the Cable Television Network Rules, 1994, an advertisement cannot be subjected to a particular time bracket.

 

 

The petitioner also answered for the labels given to the condom advertisement as " indecent, vulgar, suggestive, repulsive or offensive" and is inappropriate for children. In the reply, it was suggested that rather labeling advertisements and banning them, authorities should give certain follow-ups and guidelines for the production of such advertisements. According to the petitioner, the advertisement is useful for creating awareness. The ads can be used to prompt the use of condoms to avoid certain health issues. This will promote safe sex practices, help in decline of unwanted pregnancy, educate about the sexually transmitted diseases and infections. Backing up her argument, Ms. Sarita also brings forth that there is no academic research which proves that the advertisement of condoms is indecent or inappropriate for viewing by children.

 

 

It was suggested by the petitioner that the authorities should set up a committee or advisory board for reviewing the content before it goes on air. The committee can work with the companies and come up with ads which are educational and informing.
