The Election Commission on Wednesday rejected the nomination of former BSF jawan Tej Bahadur Yadav nominated as the Samajwadi Party candidate against Prime Minister Narendra Modi from Varanasi Lok Sabha constituency.
"My nomination has been rejected wrongly even though I had furnished the NOC from BSF that was required by the RO. I was asked to produce the evidence at 6.15 pm yesterday, we produced the evidence, still my nomination was rejected. We will go to the Supreme Court," TB Yadav quoted after cancellation of his nomination.
Mr TB Yadav was served notices Tuesday by the Varanasi returning officer over “discrepancies” in the two sets of nomination papers submitted by him. "A person who has been dismissed from service from state or central govt within last 5 years has to obtain a certificate from EC stating he/she hasn't been dismissed due to disloyalty or corruption. Certificate wasn't produced before 11 am, so, the nomination was rejected," Varanasi district magistrate said.
Mr TB Yadav said that he will approach the Supreme Court over the dismissal of his nomination. “My nomination has been rejected wrongly. I was asked to produce the evidence at 6.15 pm yesterday. We produced the evidence, still, my nomination was rejected. We will go to the Supreme Court,” he said.
Mr TB Yadav was sent a notice yesterday, asking him to clarify the cause of his dismissal by 11 am today but wasn't able to according to Election Commission.
"We were asked to reply by 11 a.m. today. My counsel has given all the answers, correspondences with the Election Commission to the RO’s office. A NOC is needed from the BSF, as to on what grounds I was dismissed,” Mr TB Yadav said
“I had filed my first nomination as an independent candidate on April 24 and on SP party symbol on April 29. If there were any issues with the nominations, why wasn’t I informed earlier? Despite lack of time, our legal team is furnishing all details to the RO,” he further added.
“I am being stopped from fighting elections as the ‘nakli chowkidar’ the country is afraid of the ‘asli chowkidar’,” he claimed
His counsel Mr Rajesh Gupta said, "We will approach the Supreme Court".
Mr TB Yadav, a constable in the 29th battalion, had posted four videos on social media in January 2017, which show visuals of poor quality of food provided to BSF soldiers at his camp along the Indo-Pakistan border in Jammu and Kashmir. After a court-martial inquiry he was dismissed from the BSF.
